These are WeWatch App and online Services terms and conditions for all users of our APP and online store ("Website Terms & Conditions").
Your privacy is important to WeWatch. We value the trust you place in us when you use our products, services, and mobile applications or interact with us through our websites or social media accounts. We take seriously the responsibility of protecting your privacy and the information we collect about you. In order to provide our services to you on a cost-effective basis and to tailor our products and services to best meet your needs and interests, we inevitably must collect information about you.
The WeWatch Privacy Policy (the "Privacy Policy") detailed below describes the types of information we collect; how we use and share that information; the choices you have regarding such use and sharing, and the rights that may be available under Singapore law when you subscribe to or interact with certain WeWatch services.
The commitments in this Privacy Policy reflect our core business objective of providing you with the most innovative and superior products and services as possible while, at the same time, offering you choices about how we use information about you to achieve that objective.
We commit to:
Communicate our privacy practices in a manner that is easily accessible and clearly describes your choices;
Offer you choices about how we may use your information for our own marketing purposes;
Not sell your personally identifiable information to anyone for any purpose ¨C this includes our customers' web browsing history, call detail records, and viewing activity;

WHEN THE PRIVACY POLICY APPLIES
The Privacy Policy applies to the information we collect when you subscribe to, access, or use the WeWatch products, services, websites and mobile applications.
Depending upon the WeWatch products and services you access, use, or to which you subscribe, parts of this Privacy Policy may not apply to you. For example, if you only use WeWatch websites, we will not collect information about the use of our video, internet, or phone services. To help clarify some of our more general statements, we provide real-world examples throughout the Privacy Policy of how we collect and use information. These are only examples and may not cover every situation. If you have questions, please contact us directly.
Some WeWatch products and services may have additional privacy practices that are described in product or service-specific sections in this Privacy Policy or may be provided to you in different ways, such as contracts for WeWatch services. To the extent there is an overlap between this Privacy Policy and a product or service-specific privacy notice, the product or service-specific notice or agreement will control with respect to such product or service.
Sometimes you may access websites (e.g., news websites, shopping websites, Internet search engine, etc.) or services (e.g., non-WeWatch email and instant messaging services or video streaming services, gaming services, data storage services, etc.) that we do not own or control through the WeWatch Platform. We urge our customers to be careful and aware of the privacy practices of these third parties, because this Privacy Policy does not extend to the parties that collect information outside of our control and does not cover information that may be collected:
when you download applications or make purchases from other companies while using our Internet or wireless services;
when you log-in and access video content provided by a third party through your device;
through any other products, services, websites, or applications, including your interactions with online video and other third party content services, even if you access them through the WeWatch Platform; and by devices that are not WeWatch devices, e.g., a tablet, smartphone, or other device that enables you to access the WeWatch products or services, or through a smart television where the manufacturer has directly enabled information gathering capabilities.
You should read the privacy policies for these other products, services, websites, applications and devices to understand their privacy practices; those privacy policies will apply to those third parties' collection of your information, even if access to such content or use of such products or devices requires you to be a WeWatch subscriber; for example, some of the premium streaming services available online that require you to authenticate your subscription using your WeWatch username and password.
All copyrights, trademarks, tradenames, logos, service marks and other intellectual property or proprietary rights in the Content on our websites or which may be accessed through our online Services are the property of Wewatch, our Affiliates and/or third party licensors, unless otherwise expressly stated by us. You may view and use this Content for personal and non Ò» commercial purposes only.
Unless we give our prior written consent:
1.1 you may not reproduce, distribute, transmit, publish, display, broadcast, store, adapt, license, alter, hyperlink or otherwise use this Content in any manner or by any means;
1.2 you may not insert a hyperlink to our websites (or any part thereof) on any other website or "mirror" or frame any Content contained on our websites on any other server or website;
1.3 no license or right is granted to you, and your access to our app and/or use of our online Services, should not be construed as granting, by implication, estoppel or otherwise, any license or right to use the trademarks, tradenames, logos or service marks appearing on such websites;
1.4 And you may not use any of the trademarks, tradenames, logos or service marks appearing on our websites as a hyperlink to any of our websites or any other website.
This Clause sets out our obligations to you in granting you access to our app and/or online Services.
2.1 While we strive to give a good online user experience, all Content contained in or accessed through our app and/or online Services are provided on an "as is" and "as available" basis. You use them at your sole risk. To the fullest extent allowed by law, we do not give any warranties, either express or implied, in relation to such Services and Content.
2.2 Specifically, we do not warrant:Ò»
2.2.1 the accuracy, reliability or quality of any Content obtained from our app and/or through our online Services;
2.2.2 that any defects in such Content will be corrected;
2.2.3 that such Content and access to them are error free and uninterrupted or available at all times
This clause describes how you should use the Content, products and Services that you access through our websites.
3.1 When accessing our Content, products and Services, you agree that:Ò»
3.1.1 all such Content, products or Services will be the sole responsibility of the person from which or whom it originated, and we do not endorse or guarantee its accuracy, reliability, integrity, legality or equality;
3.1.2 neither we nor our Affiliates will be liable in any way for any third party Content, products or services which you may access, use or acquire via our app and/or online Services;
3.1.3 you are solely responsible for all Content, products or Services that you transmit or make available via our app, online Services or on any website;
3.1.4 neither we nor our Affliates control any third party Content, products or Services which you may access, use or acquire through our app and/or online Services. Further, neither we nor our Affiliates endorse, guarantee or assume any liability for the delivery, performance, accuracy, reliability, integrity, legality or quality of such Content, products or Services;
3.2 Without prejudice to the above, our websites may include hyperlinks to websites which are owned or operated by third parties. Such third party websites are not under our control. We do not accept responsibility for the Content of or the consequences of accessing any such third party websites or any link contained in such websites. The hyperlinks found in our websites shall not be construed as an endorsement or verification of such third party websites or the Content found in these third party websites by us. You agree that your access to and/or use of such third party websites is at your sole risk and subject to the terms and conditions of access and/or use of such third party websites
3.3 Except as set out in these app Terms & Conditions, we expressly exclude all other liability we may have to you or any third party for any claims, damages, losses or expenses, including any direct, indirect, punitive, special, incidental or consequential damage, loss of profits or loss of opportunity, even if caused wilfully, recklessly or negligently.
This Clause describes your obligations to us if you wish us to provide access to our app and online Services.
4.1 In your use of our app and online Services: You must:
4.1.1 be responsible for your use of our app and online Services under your account(s) and for any Content disseminated through your account(s);
4.1.2 not use or allow any part of our app or online Services to be used in an unlawful way or in a way that could give rise to civil or criminal liability. This would include:
4.1.2.1 transmitting, posting, disseminating or soliciting any Content which may be misleading, defamatory, offensive, indecent, objectionable or illegal, or which may cause annoyance, harassment, irritation, inconvenience or anxiety to anyone, including junk/spam mail, solicitations, or distributing mail to any party who has not given permission to be included in the distribution. Junk/spam emails do not have to be sent from your account or our Network to violate these Website Terms & Conditions. Emails sent by or through a third party that advertises or directs traffic or links to your website is considered to be sent by you. If someone alleges that you have breached any of these terms, we can require you to give evidence that you have not, including adducing evidence of a "Confirmed Opt Ò» ln" mailing list where applicable;
4.1.2.2 forging or issuing misleading message headers to mask the originator of the message or employing any other method to disguise or mislead anyone on the source or quantity of the emails transmitted;
4.1.2.3 posting, disseminating, transmitting, posting, soliciting or storing Content that is pornographic or contains malware such as computer viruses, worms, trojan horses, time bombs, cancelbots or any other harmful, damaging or destructive programmes;
4.1.2.4 illegally, or without appropriate authority, accessing any part of the Services, the Network or any third party equipment, accounts, systems or networks to which you can connect through the Services (directly or indirectly), or doing anything as a precursor to such an attempt (including port, stealth, security or penetration scans or other illegitimate information gathering activity) on the servers or network of WeWatch or other Service Providers;
4.1.2.5 disrupting or undermining the security of the networks and systems connected to the Services, or violating the rules and regulations of such networks. This can include failing to update software or accessing app
4.1.2.6 collecting and/or disseminating information about others or their email addresses without their consent;
4.1.2.7 violating anyone's rights, including their intellectual property and privacy rights, or anyone's uninterrupted use of the Services or any networks, for any fraudulent, illegal or improper purposes;
4.1.2.8 reselling or providing any part or component of the Services, whether for profit or not, to third parties without our prior written consent;
4.1.2.9 advertising, transmitting, facilitating or making any Content, product or service available that may breach these Website Terms & Conditions;
4.1.2.10 doing anything to generate excessive Network traffic beyond what is normal and reasonable, cause congestion to the Network, or cause any disruption, interference, interruption or degradation in the Network or our Services; and
4.1.2.11 doing anything, even if it is lawful, that we decide is harmful to our customers, operations, reputation, goodwill or customer relations.
You agree that these restrictions are reasonable and necessary for the operation, management and maintenance of the Network. However, if any of the restrictions are held by a court to be invalid for any reason, but would be valid or effective if any part of its wording were deleted, you agree that the restriction shall apply to you with such deletions or amendments made so that it is valid and effective at law
5.1 Secure Server: You acknowledge that some Services offered on our app are provided via a secure server. All orders placed and information provided by you are provided to us via the secure server software ("SSL"). The SSL encrypts all information provided by you before they are sent to us.
5.2 Transactions: By clicking on the "Submit", "I Accept" or similar buttons, you indicate your acceptance and confirmation of your order(s) and information provided to us and you shall be liable for any payment, if any, incurred by you arising out of such order(s) or information.
5.3 Security: Your secrecy and security are important. The following describes the actions you must take to protect the security of the Services:Ò»
5.3.1 please keep your login identification, passwords, PINs and other private information confidential. You are solely responsible for all activities that occur under your accounts, even without your consent or knowledge. If you use any login identification, password or PIN that WeWatch deems to be insecure, that would be a breach of these Website Terms & Conditions;
5.3.2 we may refuse, change or remove login identification, password(s) or PINs which we deem inappropriate or offensive;
5.3.3 you must take immediate action to remedy the situation if you discover or suspect that there has been any unauthorised use of your login identification, password(s) and/or PIN or that your account security has been compromised, including by immediately informing us and changing your password(s) and/or PIN;
5.3.4 you should change your password(s), PIN or any other security identification regularly for your security;
5.3.5 and we are not responsible for the security of your account, and any equipment, network and systems you use to access the Services. We do not guarantee the security of any transmission you make.
6.1 You confirm that you have read and agree with our Data Protection Policy. Our Data Protection Policy can be accessed at our website.
6.2 We will not intentionally monitor any electronic messages sent or received by you unless required to do So by law, governmental authority or with your consent. We may, however, monitor our Services electronically to determine that our Services and Network are operating satisfactorily. We will not intentionally disclose your online communications or activities, except to comply with a court order or applicable laws, or where necessary to protect us and others from harm, or for the proper operation of our Services and Network.
7.1 We may without notice to you, restrict, suspend or terminate your account or your access to our app and/or the online Services.
7.2 We will determine, on a case Ò» by Ò» case basis, the steps which are necessary to address any breach of these Website Terms & Conditions. Such steps include investigating any suspected or alleged breach of these Website Terms & Conditions, including obtaining information from you, any complainant and the examination of Content on our server. Nothing contained in these Website Terms & Conditions shall be construed to limit our actions or remedies in any matter and we reserve at all times all rights and remedies available to us at law
You must indemnify us, including our employees, directors and agents, in full against all claims, damages, losses, liabilities, claims, costs, expenses, demands and actions resulting from your use of the Services, your negligence, omission, act or breach of these Website Terms 8 Conditions.
9.1 Except as set out in these Website T erms & Conditions, we expressly exclude all other liability we may have to you, including all liability in contract, tort, negligence, misrepresentation, strict liability or statute. This exclusion applies for our benefit and that of other Service Providers whose networks are connected to each other or to the Network, all companies, directly or indirectly owned, wholly or partly owned or controlled by us or any of these parties, and all their officers, employees, contractors and agents or anyone else to whom we or these parties are responsible ("the Relevant Parties") and whether it relates to anything caused by or resulting from anything any of the Relevant Parties does or omits to do or delays in doing (even if done, omitted or delayed wilfully, recklessly or negligently), whether or not it is contemplated or authorised by any agreement you have with us.
9.2 Under no circumstances will we or any of the Relevant Parties be liable for any:
9.2.1 special, incidental, indirect, consequential or punitive damages, losses, costs or expenses; or
9.2.2 lost profits, revenue, business or anticipated savings, loss data, loss of Content or loss of use, even if such damages, losses, costs or expenses were caused wilfully, recklessly or negligently.
9.3 We and the Relevant Parties shall not be liable for any damages, losses, costs or expenses of any nature suffered by you or any third party resulting in whole or in part from the exercise of our rights under these Website Terms & Conditions.
These Website Terms & Conditions are governed by and construed in accordance with Singapore laws and you agree to irrevocably submit to the non exclusive jurisdiction of the Singapore courts for any legal proceedings relating to these Website Terms & Conditions.
WeWatch may amend this policy from time to time. If we make any substantial changes in the way we use your personal information, we will notify you by posting an announcement on our platforms. You agree that such posting will constitute sufficient and adequate notice to you of the changes. You agree that your continued use of our products and services after such amendment will constitute your acceptance of and agreement to be bound by the modified policy.
When you access, use and/or interact with the WeWatch Services, we or our authorized service providers may use "cookies", ¡°web beacons¡± and other tracking technologies where small data files are sent to your browser, application or device to store and track information about you. The cookies, web beacons and other tracking technologies are used to track information such as the number of users and their frequency of use, online behavioral data, profiles of users and their preferred sites. They enable our own system to recognise you when you visit us again, enhance your web-viewing experience and allow for more effective online targeted advertising. You may accept or decline cookies by modifying the settings in your browser, application or device, if the browser, application or device so permits. However, note that you may not be able to use all interactive features on the WeWatch Services if cookies have been disabled completely. While this cookie can tell us when you interact with the WeWatch Services and which pages you visit, it cannot access other data including from your computer or storage device and it does not contain information intended to identify you personally.
HOW WE COLLECT INFORMATION
In order to provide you with our products and services and to keep you informed, we collect a variety of information about you when you interact with us or use our products, services, websites and applications. This information is needed for us to efficiently provide our services to you on a cost-effective basis and to tailor our products and services to best meet your needs and interests. For example, in order to provide timely and effective customer service, we keep track of when you called, what the issue was and what is the best way to get in contact with you.
If you are a WeWatch customer and you allow others to access and/or use your accounts, products or services, we will collect information about those users, as well. We may also collect information about you from third parties.
Information You Provide to Us Directly or When You Create an Account
We collect information you provide to us when you establish a customer or user account and when you contact us or otherwise communicate with us, such as:contact information (e.g., name, address, email address, and phone number) usernames, passwords, images, voiceprints, and other authenticating information, including other biometric information, associated with a WeWatch account; information about the types of services to which you subscribe, orders you place or downloads you make through a WeWatch product or service, the service options you have chosen, and any customized setting you have created£»
Information We Collect Automatically and Through Your Use of the Products, Services, Websites and Apps
We automatically collect information about your use of our services, products and devices, websites and applications in order to deliver any of our services or otherwise permit access to one of our products, such as: information from any device you use when you interact with us, including but not limited to the device identifiers, the number, types, and status of devices connected to our network, network addresses, operating system, and technical configurations of the equipment used with our services, products, websites and applications; network traffic data;performance and support data; and information about your use and the operation of WeWatch products, services, websites, applications, and their features.
We automatically collect usage information to provide you with our products and services. The information we collect will depend upon the WeWatch services to which you subscribe, access, or interact. We limit the use and sharing of such information as described in this Privacy Policy and as required by law. For example, we may collect usage information about: the channels, programs, and advertisements to which your device was tuned when you subscribe to our video service in order to provide you video content ("Video Usage Information"); the websites you visit when you are using the Internet, Mobile or WiFi services, in order to provide the service and connect you to the other sites and services you request ("Internet Usage Information"); and call records, including the phone numbers that you call and that call you, and the times and dates of those calls, the number of text messages sent and received, when you subscribe to our phone and/or mobile service ("Call Detail Information").
Additionally, if you subscribe to or use services that require us to transfer or store communications such as a WeWatch email account that includes a voicemail service, it will be necessary for us to collect the content of those communications to provide you with the service you have requested because it is required in order for the services to function. Additionally, we collect the content of any files you store in our cloud storage services and other information when it is¡£
HOW AND WHEN WE USE INFORMATION, INCLUDING FOR ADVERTISING AND TRACKING
First and foremost, we use the information we collect to provide you with reliable, high quality products and services. We also use the information we collect to communicate with you, make improvements to our products and services, investigate theft and other illegal activities, and personalize your experience. This may involve linking and combining information about you from across the Wewatch Platform, as well as from third parties ("Combined Information").
We also use the information we collect to measure and analyze how our customers are using our products, services, websites and applications. For example, when you subscribe to our video service, we use Video Usage Information to assess which programs are most popular, what programming and video content we will carry on the Services, how many people watch a program to its conclusion, and whether people are watching advertisements. We may also use this information to understand how our customers prefer to view certain kinds of programming when they use our video service, such as whether they like to watch certain programs live, or if they prefer to view them on demand, on mobile devices, or online. This information helps us provide our customers with the most innovative services with the most value.
We may also use the information we collect to create business and marketing reports, and to show you more relevant advertising, whether through our own services and websites, or on third party services and websites.
To Provide and Improve our Services, Products and Devices, Websites and Applications
We use the information we collect to:
properly deliver, maintain and improve our products, services, websites and applications;fulfill requests for new service or changes to your account or the products and services you already receive;provide you with technical support and high quality customer service, including through the use of recorded or monitored communications between you and our customer service agents;create and administer a WeWatch account, including activating your service, billing, invoicing, and debt collection activities;authenticate or otherwise provide you access to your WeWatch products and services;provide updates, upgrades, repairs or replacements for any of our service-related devices or software used in providing or receiving services;manage and configure our device(s), system(s) and network(s);understand how the service is being used, including through the creation of operational and marketing reports based on de-identified and/or aggregated service usage information;inform you of additional products and services that may be of interest to you;protect the security of the system, prevent fraud, detect unauthorized reception, use, and abuse of any WeWatch product, service, website or application, and to enforce any WeWatch policy or applicable terms of service;protect our rights, our personnel, our property, and the safety of others;maintain our accounting, tax and other records; and comply with applicabl Singapore laws and regulations, as well as for the general administration of our business.
To Communicate With You
We use the information we collect to deliver and personalize our communications with you. For example, if you use an interactive or transactional service, e.g., responding to a survey or ordering a pay-per-view event, we will use that information and information from your account to send you billing information, as well as recommendations for additional WeWatch products or services that may be of interest to you and to provide you with a more personalized experience. We may use the information to remind you of a service appointment, to follow up with you after a service request, and to send you important service-related notices and announcements.
We may send you promotional communications for products and services that may be of interest to you through the mail, over our cable system, by phone or SMS, or online. Some of these communications may be directed to you because of the WeWatch services to which you subscribe or your interactions on the WeWatch Platform, and some may be directed to you because of your general geographic location. For example, if we are launching a new service in limited areas, only residents of that particular area will receive that promotional communication. This is often called "zone" advertising.
WHEN AND WITH WHOM WE SHARE INFORMATION
We share information with others when it is necessary to provide you with the products and services you request, interact with, and to which you subscribe. We also share information with others when you direct us to do so, such as: other users on your account; when required by law or to respond to legal process; or to protect our property or rights or the safety of our employees, our customers, or other individuals. We share information with WeWatch affiliates and subsidiaries for their own marketing activities only after we have obtained any necessary consent to do so.
We do not sell or otherwise share information that personally identifies our customers, including their Internet Usage Information, Video Usage Information, or Call Detail Information, to third parties for those third parties' own use, such as marketing or advertising of their own products and services. While we have no plans to do so, if we ever changed this business practice, we would provide customers with advance notice and obtain their express consent.
Account Holders and Other Authorized Users
We may disclose any information about a customer's account and use of a service or feature to the primary account owner after appropriate authentication. The primary account owner may also authorize other users to access information on the account, which may include information about the primary account owner's use of the relevant service.
WeWatch Related Businesses
We may share information about you with other WeWatch related companies in order to provide the services you have requested or to which you subscribe, or to make your WeWatch experience more streamlined, such as through combining account information into a single location for easier access. We may also share information about you with these related companies for their own marketing purposes when we have any necessary consent required to do so.
Service Providers
We may disclose your information to third-party service providers who perform business activities and functions on our behalf to support our interactions with you such as billing and collections, payment processing, analytics and research, marketing, service delivery and customization, maintenance and operations, and fraud prevention. These third-party service providers are authorized to use your personal information only as necessary to provide these services on our behalf.
Governmental Entities or Pursuant to Valid Legal Process
We may disclose information that personally identifies you to comply with valid legal process, including subpoenas, court orders or search warrants. In some instances where there is a valid legal request or an order for disclosure of information about you, we may notify you of such request or order and then it may be up to you to object or take WeWatch action to prevent any disclosures pursuant to those requests or orders.
If you subscribe to any WeWatch services, we may be required by law to disclose information about you, including information that personally identifies you, your use of our services, and the content of your communications, to governmental entities upon receipt of valid legal process. These disclosures may be made with or without your consent and with or without notice, in compliance with the law, including the terms of process.
If you subscribe to WeWatch cable video service and a governmental entity is seeking information about your selection of video programming, the Cable Act requires the governmental entity to obtain a court order. In the proceeding relevant to the issuance of the court order, the government must provide clear and convincing evidence that you are reasonably suspected of engaging in criminal activity and that the video records sought would be material evidence in the prosecution of the case. You are to be afforded the opportunity to appear and contest the governmental entity's claims in such proceeding.
Third Parties
We do not sell or share information that personally identifies our customers or other individuals who use our products, services, or applications with third parties for their own marketing or advertising purposes.
Some of the advertisements we display may invite interactive or transactional follow-up from you. When you interact and provide your consent, we may share your contact information with such advertiser for the purpose of fulfilling your request. We may also share individually de-identified and/or aggregate information, including our business and marketing reports, with third parties for their own purposes.
If we enter into a merger, acquisition, or sale of all or a portion of our assets, we may transfer information about you, including information that personally identifies you, as part of the transaction.
WHAT CHOICES YOU HAVE TO CONTROL THE USE OF INFORMATION BY WEWATCH
You have many choices in controlling how we use and share your information for marketing and advertising purposes. For instance, you can always choose whether to receive promotional emails or text messages. When you visit our websites, you may opt out of interest-based advertising, and when you use our mobile applications, you can limit the use of ad trackers.
Some of the preferences will only apply when you subscribe to WeWatch services and may require additional account information. If you make changes to your contact information or get a new account, you will need to review and update your privacy preferences.

If you are a WeWatch customer and do not have access to Internet service, you may call us at the number provided on your monthly bill statement to be added to any of these lists.
Please note that even if you choose to limit the use of information or communications for marketing and advertising purposes, you will still receive general advertising and zone advertising, in addition to service-related messages.
Online Tracking and Interest-Based Advertising
You also have choices to limit some tracking mechanisms that collect information when you use the Websites. Many web browsers automatically accept cookies, but you can usually modify your browser's setting to decline cookies if you prefer. If you choose to decline cookies, certain features of our Websites, including the Websites themselves, may not function properly or remain accessible to you. In addition, you may also render some web beacons unusable by rejecting or removing their associated cookies. Note that if you choose to remove cookies, you may remove opt-out cookies that affect your advertising preferences.
Some of our websites use Google Analytics, a web analytics service provided by Google, Inc. Google Analytics uses cookies or other tracking technologies to help us analyze how users interact with and use the WeWatch websites, compile reports on the websites' activity, and provide other services related to website activity and usage. The technologies used by Google may collect information such as your IP address, time of visit, whether you are a return visitor, and any referring website. The websites do not use Google Analytics to gather information that personally identifies you and Google has committed not to re-identify the information it collects without your affirmative consent. The information generated by Google Analytics will be transmitted to and stored by Google and will be subject to Google's privacy policies. Many of the third party advertisers that place tracking tools on the WeWatch websites are members of programs that offer you additional choices regarding the collection and use of your information.
